These Terms of Service ("Terms") govern your access to and use of the website ratepilotfl.com and the services provided by High Mobile LLC, doing business as RatePilot ("RatePilot," "we," "us," or "our"). By accessing our Site, submitting a quote request, or communicating with us, you agree to be bound by these Terms. If you do not agree, do not use our Site or services.

1. ELIGIBILITY & ACCEPTABLE USE

You must be at least eighteen (18) years of age to use our Site and services. By using our Site, you represent and warrant that:

You are at least 18 years old and legally capable of entering into binding agreements.

All information you provide is true, accurate, current, and complete.

You will not use our Site or services for any unlawful, fraudulent, or abusive purpose.

You will not attempt to gain unauthorized access to our systems or interfere with the operation of our Site.

2. INSURANCE QUOTES ARE ESTIMATES ONLY

Any quote, rate, or coverage estimate provided through our Site or by our representatives is an estimate only, based on the information you supply. Quotes are not an offer of insurance, do not bind coverage, and do not create an insurance policy. Final premiums, terms, eligibility, and coverage are subject to underwriting review and approval by the applicable insurance carrier. Coverage is effective only when bound and confirmed in writing by the carrier.

3. NO GUARANTEE OF COVERAGE OR PRICING

RatePilot is an independent insurance agency that works with multiple licensed insurance carriers. We do not guarantee approval, specific rates, savings amounts, or the availability of any particular coverage. Insurance rates and availability are determined solely by the carriers and are subject to change without notice. Any statements regarding potential savings are illustrative and not a guarantee of results.

4. LICENSED AGENT DISCLOSURE

RatePilot operates under a licensed Florida 2-20 General Lines Insurance Agent. We act as an intermediary between you and insurance carriers. We do not underwrite insurance, make coverage determinations, or pay claims; those functions are performed solely by the insurance carriers. Our role is limited to assisting you in obtaining quotes and facilitating the placement of coverage.

5. CONSENT TO CONTACT (TCPA & FLORIDA FTSA)

By submitting your information through our Site or to our representatives, you authorize RatePilot to contact you by telephone call, SMS/text message, and email, including through automated dialing systems and prerecorded or artificial voice messages, at the telephone number and email address you provide. This authorization applies even if your number is listed on any state or the National Do Not Call Registry. Consent is not a condition of purchase. You may revoke consent at any time by replying STOP to any text message, following the unsubscribe link in any email, or contacting us directly. Message and data rates may apply; message frequency varies. Full details are described in our Privacy Policy.

5A. SMS MESSAGING PROGRAM

RatePilot may send conversational, informational, and promotional SMS messages related to insurance quote requests, policy follow-ups, appointment coordination, customer support, and optional insurance-related offers for users who have provided consent to receive such communications. Message frequency varies based on user interaction and service activity. Message and data rates may apply. Consumers may opt out at any time by replying STOP to any message or reply HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages.

6. CARRIER DECISIONS & POLICY SERVICING

All decisions regarding underwriting, policy issuance, premium, cancellation, non-renewal, and claims are made exclusively by the insurance carriers. RatePilot is not responsible for a carrier's decision to decline, modify, cancel, or non-renew coverage, or for any delay in carrier processing. If a carrier rejects or modifies a binding, we will use reasonable efforts to identify alternative options but make no guarantee of placement.

7. INTELLECTUAL PROPERTY

All content on this Site, including text, graphics, logos, the RatePilot name and mark, design elements, and software, is the property of High Mobile LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any content without our prior written permission.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, RatePilot, High Mobile LLC, and their members, officers, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to:

Your use of, or inability to use, our Site or services.

Any errors, inaccuracies, or omissions in quotes or content.

Any acts, omissions, decisions, or delays of third-party insurance carriers or platforms.

Unauthorized access to or alteration of your data despite reasonable safeguards.

Our total aggregate liability for any claim arising from these Terms or our services shall not exceed one hundred U.S. dollars ($100.00) or the amount you paid us directly, if any, whichever is greater.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RatePilot, High Mobile LLC, and their members, officers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, your misuse of our Site or services, or your submission of false or inaccurate information.

10. DISPUTE RESOLUTION & BINDING ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved through final and binding arbitration administered in Broward County, Florida, in accordance with the rules of the American Arbitration Association, rather than in court, except that either party may seek relief in small claims court for qualifying claims. You and RatePilot waive any right to a jury trial and agree that disputes will be conducted on an individual basis and not as a class action. This provision is governed by the Federal Arbitration Act.

11. GOVERNING LAW & VENUE

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Subject to the arbitration provision above, any permitted legal action shall be brought exclusively in the state or federal courts located in Broward County, Florida.

12. FORCE MAJEURE

RatePilot shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, hurricanes, severe weather, pandemics, government actions, utility or telecommunications failures, or third-party platform outages.

13. THIRD-PARTY LINKS & SERVICES

Our Site may contain links to or integrations with third-party websites and services. We do not control and are not responsible for the content, terms, or privacy practices of any third party. Your use of third-party sites and services is at your own risk and subject to their respective terms.

14. ASSIGNMENT

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, or by operation of law.

15. SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and RatePilot regarding your use of our Site and services.

16. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of our Site or services after changes are posted constitutes acceptance of the modified Terms.
